Adani Digital Labs Private Limited ( “ ADL”, “ we”, “ our” or “ us”) is acting as an intermediary/facilitator for making available the Wi-Fi internet access services (together “ Wi-Fi Services”) to its users (“ Users” or “ you”), on Adani OneApp through our mobile application related, linked, or otherwise connected thereto (collectively, the “ Adani OneApp Platform”) in collaboration with our end service provider. These Terms & Conditions (“ Terms”) constitute a legally binding agreement made between you and ADL, concerning your access to and use of the Wi-Fi Services. You agree that by availing these Wi-Fi Services, you have read, understood, and agree to be bound by: these Terms; the Privacy Policy available at https://www.adanione.com/privacy-policy. These terms and conditions shall be read in part and parcel with the terms and conditions of the Adani OneApp Platform available at: https://www.adanione.com/terms-and-conditions.
IF YOU DO NOT AGREE WITH THESE TERMS, THEN YOU ARE PROHIBITED FROM USING THE Wi-Fi SERVICES AND YOU MUST DISCONTINUE USING THE SAME IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Adani OneApp platform from time to time and are hereby expressly incorporated herein by reference. We reserve the right, in our discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the ‘Last updated’ date of these Terms and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of such updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Wi-Fi Services after the date such revised terms are posted.
These Terms are an electronic record in terms of the Information Technology Act, 2000 and rules thereunder, as applicable and the amended provisions pertaining to electronic records in various statutes, as amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.
1. By using the Wi-FI services you agree to the following terms of use:
a. When and as available, we will allow You non-exclusive Wi-FI connectivity while at all Adani operated and managed Airports. However, we do not guarantee You an internet connection; the bandwidth provided shall be at our sole discretion and Your usage may be terminated by Us at any time without further notice.
b. While we may agree to troubleshoot any connectivity problems on our network, we will not provide technical assistance for any devices not owned by us. Any assistance you might receive from us is strictly on an as is basis, without any warranties or representations.
c. The Services may be used for lawful purposes only.
d. Internet access through the Wi-FI Service is filtered, may be monitored, and We may block or restrict access to certain websites based upon Our security policies in place from time to time.
e. Any content deemed illegal, inappropriate or unethical, including but not limited to content considered by Us to be copyrighted, protected by trade secret regulation, threatening, defamatory, pornographic, illegal or terrorist in nature, may be blocked.
f. Use of the Wi-FI Services for activities deemed by Us to be illegal may be recorded, traced and turned over to the appropriate local, state or federal law enforcement authorities. However, this right to monitor in no way creates an obligation or duty on Our part to monitor Your access and Your access to any content through Our Service in no way implies or warrants the content is either legal or appropriate.
g. From time to time We may monitor the exchange of content through a Guests wireless access device as part of an investigation regarding the content and/or activities of internet usage (in search of hackers, those gaining illegal access to computer systems, and for network management). If pursuant to any such investigation We are granted or obtain access to any Guest device or content, We will limit Our access and use solely to conduct such investigation and We will take all necessary and reasonable steps to treat all such accessed content as confidential and will protect it from improper disclosure to any third-party or entity, using the same level of care to prevent disclosure or unauthorized use as We exercise in protecting Our own information of a similar nature.
h. Upon consenting, you will be on boarded to Adani OneApp Platform and will be governed as per the terms and conditions of Adani OneApp as well. While on-boarding you for the same you may provide some personal information, such as mobile number, name, email address etc. By providing this information You consent to allowing Us to periodically send to You e-mails about Our company, products and services. Usage of the data/information collected by us are governed by Our Privacy Policy. Personal information which we collect or that we otherwise obtain in connection with your use of the Service is handled in accordance with our Privacy Policy. Further, while using Our Service You are giving consent to the use of cookies that collect data/information and are handled in accordance with our above Policy.
i. Using the Wi-Fi Service, You may download and upload content to and from your wireless access device. We advise that content sent to and from a wireless access device using the Wi-Fi connection can be captured by anyone with appropriate technical knowledge. Although We incorporate wireless encryption technology into our Service, use of Our Service is at your sole risk. We are not responsible for your content whether it is personal and/or corporate in nature, and you assume sole responsibility for any theft, loss or corruption of your device or content.
j. We are not responsible for any loss of or damage to, your software and/or hardware, changes in configuration settings, security or data files while using the Wi-Fi Services. We are not responsible for any virus, Trojans, worms, malware or any other malicious software infecting your wireless access device while connected to the Wi-Fi network. We are not responsible for any power anomalies or other events that may cause damage to Your wireless access devices while using our Services.
k .By agreeing to these terms of use you expressly understand that we may monitor all traffic in and out of our gateway and therefore may gain access to and/or gain knowledge of content transmitted to or by you while connected to our services.
l. WI-FI services are provided as is, we disclaim all warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. You agree to indemnify and hold us harmless from any claims resulting from your use of the Wi-Fi services. In no event will we be liable to you or any third party for any direct, indirect, special, incidental, or consequential damages (including, without limitation, damages for loss of business/profits, data, hardware, or good will) arising out of the use of or inability to connect to the internet, even if we have been advised of the possibility of such damages.
